OTSPulse Terms of Service

§1. General provisions
- These Terms govern the provision of electronic services by the Service Provider on theOTSPulse website available at otspulse.com.
- The Service Provider is Kamil Półkośnik, operating under unregistered business activity within the meaning of Art. 5(1) of the Polish Entrepreneurs' Law of 6 March 2018, correspondence address: Kołłątaja 75/61, 15-774 Białystok, Poland. For contact, please use the contact form.
- The Terms are made available free of charge before a contract is concluded and in a form that allows them to be downloaded, stored and printed.
§2. Definitions
- Service — the otspulse.com website together with its features.
- User — a natural person at least 16 years old who uses the Service.
- Account — an individual User profile created upon registration.
- Credits — virtual settlement units used to purchase Promotions on the Service.
- Promotion — a paid service highlighting an OTS server (Spotlight, banner, sponsored post, etc.).
§3. Scope of services
- The Service Provider provides the following services free of charge: account registration, adding OTS servers to the catalog, publishing reviews, Q&A and wiki entries.
- The Service Provider provides the following paid services: purchase of Credits and Promotions described on the Service.
- All prices are listed in US dollars (USD). The payment is settled in the currency chosen by the User via the payment processor; conversion to PLN for receipt purposes uses the National Bank of Poland average exchange rate (Table A) from the day preceding the sale.
§4. Registration and account
- Registration is voluntary and free of charge. It requires a username, email address and password, or signing in with Google.
- The Service is available to users who are at least 16 years old.
- The User undertakes to provide truthful data and keep it up to date.
- An Account may be suspended or deleted in case of violation of these Terms, in particular for publishing content that is unlawful, offensive, spam, or that infringes third-party rights.
§5. Prohibited content
It is prohibited to publish on the Service any content that:
- violates applicable Polish or EU law;
- infringes copyrights, trademarks or other intellectual property rights;
- contains hate speech, incites violence, or discriminates;
- is pornographic, especially involving minors;
- promotes gambling, drugs or other illegal services;
- is spam, misleading, or constitutes fraud.
§6. Payments and Credits
- Payments are processed by external operators (including Stripe). The Service Provider does not store payment card data.
- Credits are added to the User's account immediately after the payment is recorded.
- Every new account receives 15 free Credits on signup.
- Credits are not exchangeable for cash, except as provided in §7 and where required by law.
§7. Right of withdrawal
- A consumer (within the meaning of Art. 22¹ of the Polish Civil Code) has the right to withdraw from the contract without giving any reason within 14 days of its conclusion.
- Exception: pursuant to Art. 38(1)(13) of the Polish Consumer Rights Act, the right of withdrawal does not apply to digital content (Credits spent on Promotions) delivered before the deadline expires, if the User gave their consent before the service started and acknowledged the loss of the right of withdrawal.
- Unused Credits may be refunded at the User's request submitted within 14 days of purchase.
- Cancelling an active Promotion results in a prorated refund of the unused days minus a 20% handling fee.
§8. Complaints
- Complaints should be submitted through the contact form with the subject "Complaint".
- The complaint should include: first name and last name, Account email, description of the issue and the request.
- The Service Provider examines the complaint within 14 days of receipt and informs the User about the decision electronically.
§9. Out-of-court dispute resolution
A consumer may use the European Commission's ODR (Online Dispute Resolution) platform available at ec.europa.eu/consumers/odr. Consumers in Poland may also seek help from a municipal or district consumer ombudsman or from the Provincial Inspectorate of Trade Inspection.
§10. Liability
- The Service Provider is not liable for content published by Users (servers, reviews, wiki, Q&A) or for the operation of third-party OTS servers.
- The Service Provider makes every effort to keep the Service available 24/7 but does not guarantee uninterrupted operation.
§11. Personal data
The principles for processing Users' personal data are described in the Privacy Policy.
§12. Changes to the Terms
- The Service Provider reserves the right to amend the Terms in case of changes in law, addition of new features or organizational changes.
- Users will be informed of changes by email or via an announcement on the Service at least 14 days in advance.
- If the User does not accept the new Terms, they may delete their Account.
§13. Final provisions
- The Terms are governed by Polish law.
- Disputes arising from the contract are resolved by the court of jurisdiction over the defendant, and for consumers — by the court designated by the provisions of the Polish Code of Civil Procedure.
- The Terms enter into force on 28.06.2026.
